第二十三条 违反治安管理行为人有下列情形之一，依照本法应当给予行政拘留处罚的，不执行行政拘留处罚：
前两款规定以外的案情复杂或者具有重大社会影响的案件，违反治安管理行为人要求听证，公安机关认为必要的，应当及时依法举行听证。
